Terms of Use

These terms apply when you use SProperty, as a landlord or as a tenant. By creating an account or signing in, you agree to them. Please read them together with our Privacy Policy.

1. About these terms

SProperty is provided by Sean Pickford, a sole trader in Victoria, Australia (“SProperty”, “we”, “us”). “You” means the person using SProperty. You must be at least 18. Landlords must be the owner of the property they manage, or be allowed by the owner to manage it.

2. What SProperty is — and isn’t

  • SProperty is software to help landlords keep track of rent, tenants, bills, documents and compliance, and to give tenants their own portal.
  • We are not a real estate agent, property manager, lawyer, accountant or financial adviser. Nothing in SProperty is legal, tax or financial advice.
  • Reminders, default check intervals, calculations, templates and reports are there to help. Landlords remain responsible for meeting their own obligations, including under residential tenancy, bond, safety, privacy and tax laws, and for checking what applies to their situation.

3. Rent and other money

SProperty never receives, holds or transfers rent, bonds or any other money between landlords and tenants. Tenants pay their landlord directly. Any dispute about money, the tenancy or the property is between the landlord and the tenant.

4. Your account

  • Give accurate information and keep it up to date.
  • Keep your password secure and don’t share your login. You are responsible for what happens in your account.
  • Tell us straight away at support@sproperty.app if you think someone else has used your account.

5. Landlords: your tenants’ information

When you add tenants or ask them for information, you are responsible for:

  • collecting and using their personal information lawfully, and only what you need for the tenancy;
  • telling them that you use SProperty, and pointing them to our Privacy Policy;
  • only uploading documents and information you are entitled to hold; and
  • keeping any records the law requires you to keep, including after you stop using SProperty.

6. Tenants

Your access to SProperty is set up by your landlord, and your tenancy records are managed by them. If your tenancy ends, or your landlord stops using SProperty, your access may end. Ask your landlord to correct anything that is wrong in your records. Using SProperty is free for tenants.

7. Acceptable use

You must not:

  • use SProperty for anything unlawful, misleading, harassing or discriminatory;
  • try to access another person’s account or data, or get around security or plan limits;
  • upload malware, or overload, scrape or disrupt the service; or
  • copy, resell or reverse engineer SProperty, except as the law allows.

8. Plans, trials and payment

  • The Free plan costs nothing. Its limits and the Pro features are shown on our Pricing page.
  • Pro is A$9.99 a month or A$89 a year, plus A$5 a month for each extra property. Prices are in Australian dollars and include GST.
  • New landlord accounts may start with a free 30-day Pro trial. When it ends, the account moves to Free unless you choose Pro.
  • Paid plans renew automatically until cancelled. You can cancel at any time; your account moves to Free at the end of the period you’ve paid for.
  • Except where the law requires otherwise, payments aren’t refunded for part of a period.
  • We’ll give you at least 30 days’ notice by email before changing the price of your plan.
  • If you move to Free, nothing is deleted. Your first property stays fully usable; extra properties and Pro features are kept but locked until you upgrade again.

9. Your content

You own the information and files you put into SProperty. You give us permission to store, copy, process and display them only as needed to provide SProperty to you and the people you share them with (for example, your tenants), and as described in our Privacy Policy.

10. Availability and changes

We work to keep SProperty reliable, but we can’t promise it will always be available or error-free, or that every email or notification will be delivered. Please don’t rely only on SProperty’s reminders for important deadlines. We may improve or change features over time. If we make a change that significantly reduces what a paid plan includes, we’ll tell you first.

11. Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded. Where our liability for failing to meet a consumer guarantee can lawfully be limited, it is limited to supplying the service again or paying the cost of having it supplied again.

12. Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profits, revenue or data, and our total liability to you in connection with SProperty is limited to the amount you paid us in the 12 months before the claim. This does not apply to liability that the law does not allow us to limit.

13. Ending your use

  • You can stop using SProperty at any time. Landlords can download all their records and close their account under My account (or ask us by emailing support@sproperty.app). A closed account can be reopened for 30 days; after that it is permanently deleted.
  • We may suspend or close an account that breaks these terms or puts other users or SProperty at risk. Where reasonable, we’ll warn you first and give you a chance to fix the problem and to get a copy of your records.
  • What happens to information after an account closes is set out in our Privacy Policy.

14. Changes to these terms

We may update these terms. We’ll show the date of the latest version at the top, and email landlords about significant changes at least 14 days before they take effect. If you keep using SProperty after that, the new terms apply.

15. Governing law

These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of Victoria.
